Initiated Measure 5 appeared on the November 2006 in South Dakota as an Initiated state statute, where it was approved.[1]

Ballot wording

The South Dakota Attorney General's explanation of the measure is as follows:

State law currently allows state employees to use vehicles owned or leased by the State only for state business. There is a limited exception for state employees with a supervisor’s approval. The Governor and certain law enforcement personnel are exempt.
The proposed law requires aircraft owned or leased by the State to be used only for state business, with no exceptions. A person violating this provision would now be subject to civil and criminal penalties.[2]

Proponents

South Dakota Taxpayers for Accountability (their website http://www.ourairplane.org is no longer active). Reasons mentioned for proposing the measure: government officials using public resources for personal reasons betrays the public trust and the potential for liability should an accident occur.[3]

Opponents

South Dakota Governor - Mike Rounds voted against Measure 5. Some of his reasons: "When an opportunity arises to combine state business and a personal or family event, the governor should be allowed to do so" and "this [measure] will stop future governors from saving tax dollars by paying the state for use of the state plane when non-government events happen on the same trip."[4]
