The Qualifications of the Superintendent initiated constitutional amendment would require that a Superintendent spend 40 hours in the class room annually and retain a valid teaching license. Its supporters hope to qualify it for the North Dakota 2008 ballot.

Status

The initiative has been approved by the North Dakota Secretary of State for circulation. The proponents have 1 year to collect 25,688 valid signatures to qualify the initiative for the 2008 ballot.[1]

The North Dakota Attorney General recently wrote an opinion that expressed that if the initiative was challenged in court that it would be found unconstitutional being that legislature cannot impose statutory qualifications upon the office of Superintendent of Public Instruction over and above those of the North Dakota Constitution.[2]
